For the purpose of the Data Protection Act 2018 (the “DPA”) and the Global Data Protection Regulation 2018 (the “GDPR”), the data controller is APS Intelligence Ltd, First Floor, Eastgate, Castle Street, Manchester M3 4LZ. Our nominated representative for the purpose of the DPA is Peter Carroll, Chief Executive Officer.

1.  Information we may collect from you

We may collect and process the following data about you:

 1.1       Information you give to us

You may give us information about you by filling in forms on our site, (“our site”) or by corresponding with us by phone, email or otherwise. This includes information you provide when you use our services, register to use our site, register for a live session, respond to a survey and report a problem with our site. The information you give us may include your name, address, email address, phone number, company or organisation, job role and financial and credit or debit card information to enable us to provide relevant services as part of your Giant Community Membership.

1.2       Information we collect about you

With regard to each of your visits to our site, we may automatically collect the following information:

(a)        Technical information, including the Internet protocol (“IP”) address used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform.

(b)        Information about your visit, including the full Uniform Resource Locators (“URL”) clickstream to, through and from our site (including date and time); resources you viewed; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page. 

1.3       Information we receive from other sources

We work closely with third parties (including, for example, business partners, sub-contractors in technical, payment and delivery services, analytics providers, and search information providers and may receive information about you from them.

3.1       Information you give to us

We will use this information:

(a)     To carry out our obligations to provide you with the information, products and services that are part of your Giant Community Membership.

(b)    To provide you with information about other products and services we may offer as part of the Giant Community.

(c)    To notify you about changes to the Giant Community.

(d)    To ensure that content from our site is presented in the most effective manner for you and for your computer.

3.2       Information we collect about you

We will use this information:

(a)      To administer our site and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes.

(b)     To improve our site to ensure that content is presented in the most effective manner for you and for your computer.

(c)     To allow you to participate in interactive features of our service, when you choose to do so.

(d)     As part of our efforts to keep our site safe and secure.

(e)    To make suggestions and recommendations to you about products and services that may interest you.

 3.3       Information we receive from other sources

 We may combine this information with information you give to us and information we collect about you. We may use this information and the combined information for the purposes set out above (depending on the types of information we receive).

4.   Disclosure of your information

4.1    We may share your personal information with any company which is controlled by the same person or people as control us.

 4.2       We may share your information with selected third parties including:

(a)       Business partners, suppliers and sub-contractors for the provision of your Membership of the Giant Community.

(b)        Analytics and search engine providers that assist us in the improvement and optimisation of our site.

4.3       We may disclose your personal information to third parties:

(a)        In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.

(b)        If we or all (or substantially all) of our assets are acquired by a third party, in which case personal data held by us about our customers will be one of the transferred assets.

(c)        If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our Terms of Use or Terms & Conditions of Membership and any agreements; or to protect our rights, property, or safety, our Members, or others. 

5.   Where we store your personal data

5.1       The data that we collect from you may be stored at a destination outside the UK GDPR. It may also be processed by staff operating outside the UK GDPR who works for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your Membership, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

5.2     Where we have given you (or where you have chosen) a password which enables you to access our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

5.3     We do not process or store any payment details through our site but use an external payment processor (Stripe) for the purpose of processing your subscription. Stripe’s Global Privacy Policy may be read here. 

 5.4    Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site: any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

6.   Your rights

6.1    You have the right to ask us not to process your personal data for marketing purposes notwithstanding the communications related to managing your Membership and informing you of resources available to you as part of the Giant Community. We will inform you if we intend to use your data for such purposes or if we intend to disclose your information to any third party for such purposes. 6.2       Our site may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates.  If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

7.  Access to information

7.1    You have a number of rights with regard to the personal data that we hold about you and you can contact us with regard to the following rights in relation to your personal data:

(a)  You have the right to receive a copy of the personal data we hold about you.

(b)  You have the right to correct the personal data we hold about you.

(c)  Where applicable, you may also have a right to receive a machine-readable copy of your personal data.

(d)  You also have the right to ask us to delete your personal data or restrict how it is used, consistent with the GDPR. There may be exceptions to the right to erasure for specific legal reasons which, if applicable, we will set out for you in response to your request.

(e)  Where applicable, you have the right to object to processing of your personal data for certain purposes.

(f) Where you have provided us with consent to use your personal data, you can withdraw this at any time.

We may need to request specific information from you to help us confirm your identity. If your request is complicated or if you have made a large number of requests, it may take us longer. We will let you know if we need longer than one month to respond. You will not have to pay a fee to obtain a copy of your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive.
